General Terms of Sale

1. Purpose

These General Terms of Sale (hereinafter the “Terms”) govern the contractual relationship between:

  • Groupe Progress (hereinafter “We” or “the Publisher”), operating the website pascale.ai (hereinafter “the Site”) and providing the service « Pascale » (hereinafter “the Service”),

  • and any individual or legal entity (hereinafter “You” or “the User”) subscribing to the offers and features available on the Site.

Acceptance of these Terms is mandatory for any use of the Site and the Service.

2. Description of the Service

Nature of the service
Pascale.ai is an online educational service based on “AI assistants” (hereinafter “Assistants”). These Assistants provide explanations, exercises and resources for different levels and subjects (secondary school, sixth form, higher education, retraining, etc.).

Catalogue and custom creations

    • The Site provides a catalogue of ready-to-use Assistants.

    • You may also request the creation of additional Assistants (new chapter, specific training, etc.) by providing the necessary information.

Trial period
When an account is created, the User may benefit from a free trial period (limited in duration or content), with no commitment, in order to discover Pascale’s features.

3. Access and registration

Access to the Site
You may browse the Site freely to find out about our offers and services.

User account
To access the Assistants, you must create an account by providing an email address and password. You are responsible for keeping these credentials confidential.

Responsibility
Any activity carried out from your account is deemed to have been carried out by you. You agree to inform the Publisher immediately of any unauthorised use of your credentials.

4. Prices and payment

Service plans

  • The Site offers several plans or offers allowing Users to use existing Assistants or request the creation of new Assistants/chapters.

  • The exact terms (duration, access volume, etc.) are specified on the Site at the time of subscription.

Payment

  • Payment is made by bank card or any other payment method offered at the time of ordering.

  • Once payment is completed, you receive confirmation by email.

Billing

  • The Site may make an invoice or purchase statement available directly in your customer area or by email.

  • We do not share any of your personal or banking data with third parties, except where strictly necessary to process the transaction (secure payment provider).

Creation of assistants

  • If you request the creation of a new Assistant or personalised training, a fixed contribution may apply.

  • Creation times are given for information only and may vary depending on the complexity of the request.

5. Use of the Service

General operation

  • You can access the Assistants from your personal space, ask questions and request explanations or exercises.

  • The content provided by the Assistants is designed for educational use and should be considered as support, with no guarantee of exact correspondence with an official curriculum.

Modification or interruption of the Service

  • The Publisher may carry out maintenance operations, develop features or modify the organisation of the catalogue.

  • In the event of a prolonged interruption, the Publisher will endeavour to inform Users as soon as possible.

6. Obligations and liability

Best-efforts obligation
We make every effort to ensure the quality and availability of the Service. However, no guarantee of performance or results is given regarding success in an exam, diploma or certification.

Lawful use
You agree to use the Service only for lawful purposes and in compliance with these Terms.

Limitation of liability

  • The Publisher cannot be held liable for the consequences of using information provided by the Assistants.

  • The User remains free to follow or not follow the guidance, advice and content made available.

7. Data protection (GDPR)

Personal data collected

  • When your account is created, we collect: email, surname, first name and password (encrypted).

  • When making a purchase, you may be asked for your billing address.

Storage and confidentiality

  • No data is transmitted to third parties.

  • Your data is stored on secure servers and is used only to manage your account and improve the Service.

Exercising your rights

  • In accordance with the General Data Protection Regulation (GDPR), you have the right to access, rectify, erase and port your data.

  • You may also request restriction of processing or object to the processing of your data.

8. Right of withdrawal

Legal period
In accordance with the law, consumers have a period of 14 days from conclusion of the contract to exercise their right of withdrawal.

Full waiver
You acknowledge that as soon as you start using the Service (access to resources or Assistants), the supply of digital content has begun. This results in the full waiver of your right of withdrawal, in accordance with Article L221-28 of the French Consumer Code.

9. Intellectual property

Protected content
The Site, the “Pascale.ai” brand, texts, graphics, logos and any other original content are protected by intellectual property law.

Licence to use
The Publisher grants you a non-exclusive, non-transferable licence to use the Site and the Service. Any unauthorised reproduction, representation or exploitation is strictly prohibited.

10. Suspension and termination

Suspension
The Publisher may suspend your access to the Service in the event of serious or repeated breach of these Terms or applicable law.

Termination
In the event of a proven breach (fraud, unlawful use), the Publisher may terminate your contract without notice or compensation.

11. Modification of the Terms

We reserve the right to modify these Terms at any time. Changes will take effect as soon as they are published on the Site. You will be invited to accept them in order to continue using the Service.

12. Applicable law and dispute resolution

Applicable law
These Terms are governed by French law.

Disputes

  • In the event of a dispute, the parties undertake to seek an amicable solution.

  • Failing agreement, the dispute will be brought before the competent French courts.

13. Entry into force

These Terms take effect from their publication date, soit le 25/03/2025. Any order or use of the Service after this date constitutes full acceptance of these terms.
